Three Year Limited Warranty
Thermal Products Corp. (Thermal) warrants that is Electra-Flow units,
exclusive of any options and accessories (whether field or factory
installed) shall be free from defects in material and/or workmanship for
three (10) years after shipment, and shall, at its sole option, repair
or replace any parts that fail due to defective material and
workmanship, provided that: 1) the defects were not due to abuse,
neglect, abnormal operation, or lack of proper maintenance; and 2) the
units have been used in the manner intended therefore and all parts and
controls remain unaltered; and 3) such parts have been inspected by
Thermal Products and found to be defective.
Thermal makes no Warranty of Merchantability of products or of their
fitness for any purpose or any other express or implied warranty which
extends beyond the limited warranty above. Thermal Products liability
for any and all losses and damages resulting from defects shall in no
event exceed the cost of repair or replacement of parts found defective
upon examination by Thermal. In no event shall Thermal be liable for
incidental, indirect or consequential damages or damaged for injury to
persons or property. Thermal Products shall not be responsible for
freight to and from its plant in connection with the inspection, repair
or replacement of parts under the terms of this limited warranty nor for
cost of removal or installation.
